Hereinafter “Lucile Ateliers Designs”.
Article 2 – Scope
These general terms and conditions of sale (GTCS) apply to all sales concluded on lucileateliersdesigns.com between Lucile Ateliers Designs and any natural person acting as a consumer (hereinafter the “Customer”).
Any order implies full and unconditional acceptance of these GTCS. The applicable GTCS are those in force on the date of the order. Lucile Ateliers Designs may amend them at any time; changes do not apply to orders already placed.
Article 3 – Products
Lucile Ateliers Designs offers:
- digital knitting patterns in PDF format, downloadable after payment;
- physical products, including the book Nature, garde-robe tricotée.
The essential characteristics of each product (sizes, level, required materials, pattern language, etc.) are presented on its product page. Photos are non-contractual. The result of the finished item depends on the yarn used, the gauge, and how the instructions are followed. Lucile Ateliers Designs cannot be held liable for any difference between the item made by the Customer and the model shown.
Article 4 – Price
For customers residing in France and outside the European Union: VAT not applicable, Article 293 B of the French Tax Code (CGI).
For digital products sold to customers residing in another European Union country: prices include the VAT of the buyer’s country, declared and paid by Lucile Ateliers Designs via the EU One-Stop Shop (OSS).
Shipping costs for physical products are indicated before the order is validated. For deliveries outside the European Union, customs duties or import taxes may be required by the destination country. They remain the responsibility of the Customer, who is invited to check with the authorities in their country.
Lucile Ateliers Designs reserves the right to change its prices at any time. Products are invoiced at the price in force at the time the order is validated.
Article 5 – Order
The Customer selects their products, checks the contents of their cart, enters their details, then validates their order after reading and accepting these GTCS. For digital products, they also confirm their agreement to immediate supply and their waiver of the right of withdrawal (see Article 9).
An order confirmation is sent by email. It summarizes the products ordered, their price and, where applicable, the download links.
Lucile Ateliers Designs reserves the right to cancel or refuse any order in the event of an existing dispute with the Customer, suspected fraud, or a supply issue. The Customer will then be informed and fully refunded.
Article 6 – Payment
Payment is made online at the time of the order, by bank card via WooPayments (secure payment module) or via a PayPal account. Lucile Ateliers Designs never has access to the Customer’s full bank details.
Products remain the property of Lucile Ateliers Designs until full payment of the price.
Article 7 – Delivery
Digital products. After payment is validated, patterns are available immediately: via a download link sent in the confirmation email, and from the “My account” area. Links remain valid without time limit. In case of download difficulty, the Customer can write to contact@lucileateliersdesigns.com.
Physical products. Delivery is offered in France and internationally, according to the methods displayed at the time of the order (tracked letter, Colissimo, etc.). Products are shipped after payment is received, within 4 business days. Delivery times are given for information only. The risk of loss or damage is transferred to the Customer when they physically take possession of the products.
If a product becomes unavailable after the order, the Customer is informed by email. An alternative or a refund, partial or full, is offered.
Article 8 – Pattern use licence
The purchase of a pattern grants the Customer a personal, non-commercial right of use. It is forbidden to copy, share, resell, translate or distribute the pattern, in whole or in part, in any form whatsoever (file, printout, photo, online publication, etc.).
Items made from the patterns are for strictly personal use and may not be sold.
Article 9 – Right of withdrawal
Physical products. In accordance with Article L221-18 of the French Consumer Code, the Customer has 14 days from receipt of the products to exercise their right of withdrawal, without having to justify reasons or pay penalties. They inform Lucile Ateliers Designs of their decision by a clear statement, sent to contact@lucileateliersdesigns.com, or by means of the withdrawal form in the appendix.
Products must be returned complete, in their original condition, within 14 days following communication of the withdrawal decision. Return shipping costs are borne by the Customer.
Lucile Ateliers Designs refunds all sums paid, including the initial delivery costs (based on the standard delivery method), within 14 days from withdrawal, using the same payment method as used for the order. The refund may be deferred until the returned products are received.
Exceptions. In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:
- the supply of digital content not supplied on a tangible medium, such as a PDF pattern, where performance has begun after the Customer’s prior express consent and express waiver of their right of withdrawal;
- service provisions, such as knitting classes, fully performed before the end of the withdrawal period with the Customer’s express consent.
Article 10 – Legal warranties
All products, including digital content, benefit from the legal warranty of conformity (Articles L217-3 et seq. and L224-25-12 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
Under the warranty of conformity, the Customer has 2 years from delivery of the product to take action. They may request that the product be brought into conformity or, failing that, a price reduction or cancellation of the sale. In the event of a defective pattern (unreadable file, error in the instructions), Lucile Ateliers Designs undertakes to provide a corrected file.
Article 11 – Liability
The products offered comply with French legislation. Lucile Ateliers Designs cannot be held liable for non-compliance with the legislation of the delivery country, which it is the Customer’s responsibility to check. Its liability cannot be engaged in the event of misuse of a product, nor for inconveniences inherent to the use of the Internet (service interruption, external intrusion, computer virus, etc.).
Article 12 – Intellectual property
All elements of the lucileateliersdesigns.com website (patterns, texts, photos, videos, logos) are the exclusive property of Lucile Francomme and are protected by copyright. Any reproduction or use, even partial, without prior written authorization is prohibited.
Article 13 – Personal data
Personal data collected when placing an order is processed in accordance with the General Data Protection Regulation (GDPR). Its use, retention period and the Customer’s rights are detailed in the Privacy Policy.
Article 14 – Evidence and archiving
Data recorded by the website constitutes proof of orders and transactions. Invoices are archived on a reliable and durable medium, in accordance with legal obligations.
Article 15 – Customer service and mediation
For any question or complaint, the Customer can write to contact@lucileateliersdesigns.com.
Article 16 – Applicable law
These GTCS are written in French and governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the dispute will be brought before the competent courts in accordance with ordinary law rules. These provisions do not deprive a Customer residing in another European Union country of the protection granted by the mandatory rules of their country.
